As per the Indian Criminal Procedure Code, a complaint means any allegation made orally or in writing to a Magistrate with a view to his taking action under this Code that some person, whether known or unknown, has committed an offense, but does not include a police report (Section 2(d)).
However, in cases where a police officer after investigation, discloses the commission of a non-cognizable offense, the report made by the police officer shall be deemed to be a complaint, and the police officer shall be deemed to be the complainant (Section 2(d) Explanation).
Therefore, in Mr. X’s case, since the offense committed by Mr. Y is non-cognizable, the police officer can only file a complaint on behalf of Mr. X. This complaint will be treated as a complaint under the Criminal Procedure Code, and the Magistrate will take necessary action against Mr. Y as per the law. However, it is essential to note that the police officer will be deemed to be the complainant in such cases.
